Welcome to Toy Street 8! These Terms of Service (“Terms”) govern your access to and use of our website, mobile application, products, services, content, and any other domains provided by Toy Street 8 (collectively, the “Services”). By accessing or using our Services, you agree to comply with these Terms. If you disagree with any part of these Terms, please do not use our Services.
1.DEFINITIONS
“Account” means an account you create when accessing our Services.
“Offers” means special programs, promotional offers, special gifts, both digital and physical, that Toy Street 8 may occasionally provide to eligible users.
“Services” refers to all products, services, features, content, applications, and websites provided by Toy Street 8.
“Terms of Service” or “Terms” refers to these terms and conditions governing your use of our Services.
“User Content” means any data, text, images, videos, comments, reviews, or other content uploaded, submitted, or transmitted by you through the Services.
“Virtual Items” refers to virtual currencies, specifically including but not limited to our virtual coins known as “FIRE,” tokens, or points for use within the Services.
“Toy Street 8 Affiliates” refers to Toy Street 8 and/or Toy Street 8’s third-party content providers, distributors, licensees, licensors, or other related entities.
2. CHANGES TO THESE TERMS
We reserve the right, at our sole discretion, to change, modify, add, or remove portions of these Terms and our Privacy Policy at any time. We will announce such amendments by posting the updated Terms or Privacy Policy on our website or within our Services. We may provide additional notice via email or direct messaging within the Services for significant changes. Unless explicitly stated otherwise, all changes are effective immediately upon posting. By continuing to use our Services after such changes are posted, you expressly agree and consent to the revised Terms and Privacy Policy. The most current versions of these Terms, the Privacy Policy, and any additional policies, guidelines, or rules will always be accessible through our website or Services. If a dispute arises between you and Toy Street 8, the Terms and Privacy Policy in effect when we received actual notice of your dispute will apply to that dispute. You cannot alter or modify these Terms or the Privacy Policy without obtaining our explicit written consent. In case of any conflict between these Terms and other Toy Street 8 policies or terms, these Terms and the Privacy Policy will take precedence.
3. ACCOUNT INFORMATION AND SECURITY
To access certain Services, we may require you to create an Account by choosing a password and providing personal details including, but not limited to, your name, date of birth, email address, phone number, and payment information. Your personal information will be handled according to Toy Street 8’s Privacy Policy. You agree to provide Toy Street 8 with accurate, complete, and regularly updated information, especially your contact information such as email address and phone number. You are solely responsible for safeguarding your Account and password details. Do not share or permit access to your Account by third parties. You acknowledge that you are entirely responsible for all actions undertaken through your Account, whether authorized by you or not, including purchases made through any payment methods associated with your Account (e.g., credit card, FPS, PayMe). You agree to immediately notify Toy Street 8 of any actual or suspected loss, theft, unauthorized access, or fraudulent use of your Account or password.
4. PRIVACY
Toy Street 8’s Privacy Policy clearly describes how we collect, store, use, and share information related to you, your computer, or your mobile device, and how you can manage or share this information through our Services. By accessing or using our Services, you expressly acknowledge and consent to our practices described in the Privacy Policy. If you do not agree with our Privacy Policy or the way we handle your personal information, please cease using our Services immediately. We strongly recommend that you carefully review our Privacy Policy to make informed decisions.
5. USING OUR SERVICES
Eligibility: You may not use our Services if:
You are unable to enter a legally binding agreement with Toy Street 8.
You have been previously banned from any of Toy Street 8’s Services.
If you are under the age of 18, or the age of majority in your jurisdiction, you represent and warrant that your legal guardian has reviewed and consented to these Terms.
Service Changes and Limitations:
The Services provided by Toy Street 8 will evolve, and we may require you to accept periodic updates to the Services and related Terms and Privacy Policy. Occasionally, we may require you to update software to continue accessing or utilizing our Services, and such updates may occur remotely without prior notification. Toy Street 8 retains the right, at any time, to discontinue, suspend, or terminate providing our Services, temporarily or permanently. Should this occur, your license to access or use any part of the Services may be automatically revoked or suspended. Toy Street 8 is not obligated to provide any refunds, benefits, or other compensation for discontinued Services or previously earned or purchased Virtual Items.
Toy Street 8, at its sole discretion, may also limit, suspend, modify, terminate, or delete Accounts or restrict access to any portion of our Services, delay or remove hosted content, and is under no obligation to compensate for losses or other consequences resulting from such actions.
Account Deletion:
You may discontinue using our Services at any time and request we cease active use of your personal data by following procedures outlined in our Privacy Policy. Except where required by applicable law, we are not obligated to offer refunds, benefits, or compensation upon Account deletion requests.
6. OWNERSHIP; LIMITED LICENSE
Services:
The Services provided by Toy Street 8, including but not limited to text, images, graphics, logos, animations, interfaces, audio-visual elements, and other materials are protected by applicable intellectual property laws such as copyright, trademarks, trade dress, patents, and other applicable rules and regulations. Toy Street 8 either owns or has properly licensed all content appearing within the Services. These Terms do not grant you, or any other party, any right, title, or interest to the Services or any content therein.
Provided you fully comply with these Terms and other applicable rules, Toy Street 8 grants you a limited, non-exclusive, non-transferable, revocable license to access and utilize our Services solely for your own personal, non-commercial use. You agree not to use the Services for any other purposes.
Any violations of these Terms or applicable laws, including but not limited to intellectual property rights, may lead Toy Street 8 to take corrective actions against you, up to and including permanently suspending or terminating your Account. Any attempts to disrupt, interfere with, or undermine the legitimate operation of our Services constitute a violation of these Terms and applicable laws and may result in civil or criminal liabilities.
Account and Virtual Items:
Notwithstanding any provisions in these Terms or elsewhere, you acknowledge that the Account you create on Toy Street 8, and any associated Virtual Items, are not your property. Toy Street 8 grants you only a limited license to use your Account and Virtual Items while the Services are actively offered. Toy Street 8 reserves the right to delete or terminate inactive Accounts or Virtual Items at our sole discretion.
User Content:
By uploading or transmitting User Content through our Services, you affirm it will be accurate, non-confidential, lawful, free from contractual restrictions, authorized by involved third parties, and free from viruses or malicious software. Toy Street 8 processes your User Content per our Privacy Policy. While you retain ownership of your User Content, you grant Toy Street 8 a perpetual, irrevocable (except as explicitly described herein), worldwide, fully-paid, royalty-free, non-exclusive license to use your User Content, including derivative works, in association with providing, marketing, and promoting our Services. You agree to waive any moral rights in your User Content to the fullest extent permitted by applicable law.
This license ends upon written request to delete your User Content. However, certain User Content may persist, including content shared publicly or required by law to be retained. Toy Street 8 disclaims responsibility for unauthorized use of any User Content posted publicly within our Services.
7. MONITORING USE OF SERVICE AND USER CONTENT
Toy Street 8 has no obligation to actively monitor User Content and is not responsible for monitoring the Services for inappropriate or illegal User Content or misconduct by users. Nonetheless, Toy Street 8 reserves the right, at our sole discretion, to edit, refuse to post, or remove any User Content at any time without notice or liability. Toy Street 8 may, at our discretion, monitor and/or record your interactions with our Services or your communications with Toy Street 8 (including without limitation chat text, voice communications, comments, and other interactions) to ensure compliance with these Terms or applicable laws.
8. PAYMENT TERMS
If any charges are associated with your use of our Services, you expressly agree to pay such charges. You authorize Toy Street 8 to charge your registered credit card, or bill your account through the Apple App Store, Google Play, or other applicable app platforms for all charges incurred by you within the Services.
Even if the basic Service is provided free of charge, there may be additional charges related to optional content within the Services, such as Virtual Items, “FIRE” virtual coins, Ichiban Kuji tickets, and similar virtual goods, for which you expressly agree to pay. You may be able to prevent unintended purchases by adjusting your device’s settings or parental controls.
Please note that devices (such as iPhones or iPads) may remain logged in for a period after downloading the Service or making a purchase, potentially allowing unauthorized charges without re-entering your password. This functionality is device-specific and outside our control; however, you may modify this setting in your device’s settings menu.
Prices displayed within the Service exclude applicable taxes, currency exchange settlements, and related fees unless explicitly stated otherwise. You acknowledge that you may incur additional costs related to your use of our Services, such as data charges, internet access, or text messaging fees. You are solely responsible for paying these incidental fees and taxes related to your usage.
We reserve the right to suspend or terminate your Account and/or payment functionality, or to cancel any pending prize shipments if we receive a chargeback from your credit card company or are notified of actual or suspected fraudulent activity associated with your payment methods.
Any payments made for the Service, Virtual Items (e.g., FIRE coins), or virtual goods are non-refundable, except as required by applicable law or explicitly outlined in these Terms. If we discover that your Virtual Items have not been properly credited or were lost due to a system error, we will credit your Account accordingly. However, no refunds or cash exchanges will be provided.
9. PROMOTIONS AND OFFERS
From time to time, Toy Street 8 may offer limited-time promotions or special offers. These promotions and offers will have official rules that supplement these Terms, and we encourage you to review them carefully.
Toy Street 8 is under no obligation to provide, and users are not obligated to accept, any promotional Offers. Offers provided by Toy Street 8 are not transferable, redeemable, or exchangeable for other items of value unless expressly indicated by Toy Street 8. By accepting an Offer, you might be required to sign additional documentation such as declarations of eligibility or liability releases.
Certain Offers may involve taxes, shipping charges, or activities beyond our Services, all of which will be disclosed clearly before acceptance. By accepting any Offer, you explicitly assume full liability associated with it.
Our Services may include advertisements or promotions from third parties. Our Privacy Policy details the type of information we may share with advertisers—please review it carefully. Occasionally, our Services might link to third-party websites or promotions. Any charges, obligations, or interactions between you and these third-party providers are entirely your responsibility. Toy Street 8 makes no representations, guarantees, or endorsements regarding third-party content, goods, or services, even if linked from our Services. We are not responsible for third-party websites’ practices or their privacy policies, nor the collection and usage of your information once you leave our Service or interact with third-party providers.
10. COPYRIGHT NOTICES/COMPLAINTS
Toy Street 8 respects the intellectual property rights of others and expects our users to do the same. We respond promptly to valid notices of alleged copyright infringement in compliance with applicable local laws. Additionally, we honor and do not interfere with standard technical measures copyright owners employ to protect their rights.
If you believe your copyrighted work has been infringed, please promptly notify Toy Street 8 with the necessary information as specified by applicable copyright laws. Toy Street 8 will take appropriate actions upon receiving valid infringement notifications.
11. FEEDBACK AND UNSOLICITED IDEAS
Toy Street 8 may occasionally request your feedback regarding our Services through promotions or customer insights programs. Any feedback provided in response to these specific requests will be governed by the rules of the respective promotion or program.
Toy Street 8 does not accept unsolicited ideas or suggestions related to products, services, improvements, designs, or any business operations. If you submit unsolicited ideas despite our policy, you acknowledge and agree that Toy Street 8 will have no obligation or liability regarding such submissions, and Toy Street 8 will have the unrestricted right to use, disclose, reproduce, or exploit any unsolicited ideas submitted to us without compensating you in any manner.
12. WARRANTY DISCLAIMER; SERVICES AVAILABLE ON AN “AS IS” BASIS
Neither Toy Street 8 nor its affiliates make any guarantee or warranty regarding the uninterrupted or error-free provision of the Services. Your use of the services is at your own risk. The services are provided on an “as is” and “as available” basis. To the extent permitted by applicable law, Toy Street 8 and its affiliates expressly disclaim all warranties and conditions, whether express or implied, including, without limitation, implied warranties of title, merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment.
If the jurisdiction in which you reside does not allow these disclaimers, they will not apply to you. If applicable law requires a specific warranty period, the warranty period provided by Toy Street 8 shall be limited to the lesser of thirty (30) days from your first use of the Services or the shortest duration permitted by law.
13. LIMITATIONS; WAIVERS OF LIABILITY
You acknowledge that Toy Street 8 and its affiliates will not be liable to you for:
(1) any indirect, incidental, special, exemplary or consequential damages, including, without limitation, loss of profits, goodwill, data, or any other losses arising from your use or inability to use the service; or
(2) the conduct, content, or activities of third parties, including other users of the service or operators of external websites or platforms.
You acknowledge and agree that the risk associated with your use of the service, as well as any interactions or transactions with third parties, rests entirely with you.
To the fullest extent permitted by applicable law, the disclaimers and limitations of liability set forth in these terms apply to all damages or injuries arising from the service, including, without limitation, damages or injuries related to breach of warranty, breach of contract, tort (including negligence), or any other legal theory.
To the maximum extent permissible under applicable law, the total liability of Toy Street 8 and its affiliates will be limited to the amount you have paid Toy Street 8 or its affiliates during the thirty (30) days immediately preceding the date of your claim. If no such payment was made during this period, your sole and exclusive remedy for any dispute with Toy Street 8 or its affiliates is to discontinue use of the service and terminate your account.
Some jurisdictions may not allow certain exclusions or limitations as described above; if such laws apply to you, some or all of these exclusions or limitations may not be applicable.
14. INDEMNITY
If your use or misuse of the Service, or your violation of these Terms or any other applicable rules, results in loss, damage, or a claim against Toy Street 8 or any Toy Street 8 Affiliate, you agree to indemnify, defend, and hold harmless Toy Street 8 and its Affiliates on a full indemnity basis (meaning you will fully compensate Toy Street 8 and its Affiliates, dollar-for-dollar, for such loss, damage, or claim). This indemnity includes reimbursing Toy Street 8 and its Affiliates for any legal fees and expenses incurred.
Toy Street 8 or its Affiliates may choose to take exclusive control of the defense in any case for which you are required to indemnify them, at your expense. You agree to cooperate fully in such defense. Toy Street 8 and its Affiliates will make reasonable efforts to notify you if they learn of a claim for which you must indemnify or reimburse them. This indemnity obligation shall survive even after your Account is terminated or deleted or after you cease using the Services.
15. APPLICABLE LAW
These Terms and any dispute or claim arising from or related to them or your relationship with Toy Street 8 shall be governed by and construed under the laws of the Hong Kong Special Administrative Region (“Hong Kong”), without regard to its conflict of laws principles.
16. VENUE FOR LEGAL DISPUTES NOT SUBJECT TO ARBITRATION
Any judicial proceedings arising from or related to these Terms or your relationship with Toy Street 8 that are not subject to arbitration must be brought exclusively in the competent courts located within Hong Kong, unless both parties mutually agree upon a different venue. You and Toy Street 8 consent to personal jurisdiction in Hong Kong courts and waive any objections based on jurisdiction or venue.
17. SEVERABILITY
If any part of these Terms or our Privacy Policy is found to be unenforceable by a court of competent jurisdiction, the remainder of these Terms and Privacy Policy will remain fully enforceable and binding. The unenforceable portion will be substituted with provisions that reflect the parties’ original intent as closely as legally permissible.
18. ASSIGNMENT
Toy Street 8 may freely assign or delegate our rights or obligations under these Terms or our Privacy Policy, in whole or in part, to any person or entity at any time, with or without notice to you and without your consent. You may not assign or delegate your rights or obligations under these Terms or our Privacy Policy without obtaining Toy Street 8’s prior written consent. Any attempt by you to assign or delegate without our consent will be void and without effect.
19. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any additional policies or rules expressly incorporated herein, constitute the entire agreement between you and Toy Street 8 concerning the Service. They supersede all prior understandings, arrangements, communications, or agreements relating to the Service, whether established electronically, orally, in writing, or by custom, practice, policy, or precedent between you and Toy Street 8.
20. LANGUAGE OF THE TERMS
If Toy Street 8 provides translated versions of these Terms, the Privacy Policy, or any other applicable policies or documents, such translations are provided solely for informational purposes. In the event of any discrepancy or inconsistency between the English language version and a translated version, the English language version shall prevail and be legally binding.
21. NO WAIVER
Failure by Toy Street 8 to enforce any provision or exercise any rights under these Terms or our Privacy Policy shall not constitute a waiver of our right to enforce such provision or exercise such rights in the future. Any waiver of any provision or right under these Terms or the Privacy Policy must be in writing and signed by both Toy Street 8 and you to be legally binding.
22. NOTICES
Toy Street 8 may provide you notices or communications regarding the Service or these Terms by posting such notices within the Toy Street 8 website or app, sending you emails, or using other reasonable means based on the contact information you have provided to us.
If you are required or wish to provide notice to Toy Street 8 under these Terms or our Privacy Policy, you must do so in writing and address it directly to Toy Street 8 at the contact address listed on our website. Notices provided through methods not outlined herein will be ineffective and hold no legal significance.
23. EQUITABLE REMEDIES
You acknowledge and agree that the rights and obligations specified in these Terms and our Privacy Policy are of a unique and irreplaceable nature. In the event you breach or intend to breach these Terms or our Privacy Policy, you acknowledge that monetary damages alone will not be adequate compensation for Toy Street 8. Therefore, Toy Street 8 shall be entitled to seek injunctive or other equitable relief (for example, obtaining a court order compelling you to cease such breach or threatened breach), without the necessity of posting a bond, surety, or demonstrating actual damages.
You agree that your sole remedy for any claim arising from the Service or these Terms shall be limited exclusively to monetary damages as restricted by Section 13 (Limitations; Waivers of Liability). You expressly agree not to seek injunctive or equitable relief or otherwise seek to stop Toy Street 8 from operating any aspect of the Service.
24. FORCE MAJEURE
Toy Street 8 shall not be responsible or liable for any failure, delays, or problems arising from circumstances beyond our reasonable control. Such events include, without limitation, natural disasters (such as earthquakes or floods), acts of war, terrorism, riots, embargoes, civil or military disturbances, fire, accidents, network infrastructure failures, strikes, pandemics, shortages of transportation facilities, fuel, energy, labor, or materials, or actions by governmental authorities.
